These \u201caffirmative litigation\u201d suits<br \/>\ndeparted drastically from these offices\u2019 usual role, which typically involves representing the<br \/>\njurisdiction in transactions and defending it against litigation. To understand what motivated<br \/>\nlocal jurisdictions, he adopts a full-cycle research approach that includes interviews with local<br \/>\ngovernment attorneys as well as event-history analyses of opioid lawsuits filed by U.S. counties.<br \/>\nHis analyses point to the important role of a mechanism he calls institutional scarring, defined<br \/>\nas a lingering sense of having been wronged in the past by another organizational actor.<br \/>\nCounties\u2019 experiences with allowing states to take the lead decades earlier in lawsuits against<br \/>\nBig Tobacco\u2014and therefore to distribute the resultant settlement funds\u2014left many<br \/>\njurisdictions feeling scarred. When the prospect of legal action against opioid manufacturers<br \/>\nemerged, this institutional scar was activated, shaping local attorneys\u2019 legal consciousness and<br \/>\nmaking them reluctant to leave litigation in state officials\u2019 hands. Interviews and event-history<br \/>\nanalyses alike provide support for this explanation.
